A Montreal man accused of being an al-Qaeda sleeper agent said on Thursday his lawyers proved to Canada's top court that the investigation against him was biased.
Moroccan-born Adil Charkaoui is battling a deportation order under a federal security certificate. He was jailed for 21 months under the terms of the certificate, but released on strict bail conditions in February 2005.
In 2005, during a bail review hearing, CSIS investigators testified they destroyed records of their interviews with him, but kept summaries, as policy dictates at the security agency.
It was part of the evidence that served as the basis for alleging Charkaoui was an al-Qaeda member. Charkaoui has repeatedly denied any terrorist activity, and his lawyers have argued the destroyed interviews could have helped exonerate him.
